Terms of Service
These terms govern your use of Rowan Trades, an application for contractors provided by Recherché Merchant Solutions, Inc. ("RMS", "we", "us"). By installing or using Rowan Trades you agree to these terms on behalf of your business.
1. The service
Rowan Trades runs inside your CRM account and stores estimates, signatures, jobs, tasks, change orders, payment schedules, payment records and cost records to provide the service. We may improve, change or retire features over time.
2. Your account and your team
You are responsible for who you give access to and for activity under your account. Keep passwords and keys private.
3. Estimates, contracts and signatures
Rowan Trades provides tools to prepare estimates and collect electronic signatures. You are responsible for the content of your estimates, contracts and change orders, for your licensing, and for following the laws where you work, including required notices such as cancellation rights, lien notices and contract requirements. Rowan Trades is not legal advice.
4. Payments
Card and ACH payments are processed by your payment processor under your agreement with them, not by RMS. Rowan Trades creates payment requests and records results. Pricing programs such as dual pricing must be configured and disclosed in line with card brand rules and the laws where you operate; you are responsible for that compliance.
5. Messages and tags
Rowan Trades does not send messages to your customers on its own. Links are sent by you. Tags added to contacts do not send anything by themselves; any workflow that starts from them is yours, and you are responsible for consent and for following messaging laws and carrier rules.
6. Taxes and accounting
Rowan Trades provides job costing and payment reports. You and your accountant remain responsible for taxes, filings and records.
7. Fees
Fees for Rowan Trades are set out in your plan or agreement. If fees change, we'll give notice before the change takes effect.
8. Your data
You own your business data. We use it only to provide and support Rowan Trades, as described in our Privacy Policy. You can request an export of your Rowan Trades records.
9. Acceptable use
Don't use Rowan Trades to break the law, process prohibited transactions, send unsolicited messages, or interfere with the service or other users.
10. Availability and changes
We work to keep Rowan Trades available but don't guarantee uninterrupted service. Your CRM, payment providers and other third-party services can affect availability.
11. Disclaimers and liability
Rowan Trades is provided "as is." To the extent allowed by law, RMS is not liable for indirect, incidental or consequential damages, or for lost profits, and our total liability is limited to the fees you paid for Rowan Trades in the twelve months before the claim.
12. Ending use
You can uninstall Rowan Trades at any time. We may suspend access for non-payment or misuse. After you leave, we'll keep your records for a reasonable period so you can request an export, then delete them.
13. Governing law
These terms are governed by the laws of the State of Oklahoma.
